Terms of Service for SellCraft

Please read these Terms of Service ("Terms") carefully before using the SellCraft mobile application (the "App") operated by Andromeda Kinship ("Company," "we," "our," or "us").

1. Acceptance of Terms

By downloading, installing, accessing, or using SellCraft, you ("User," "you," or "your") agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to all of these terms, do not download, install, or use the App.

These Terms constitute a legally binding agreement between you and Andromeda Kinship. Your use of the App is also subject to Apple's App Store Terms of Service and/or Google Play Terms of Service, as applicable.

2. Description of Service

SellCraft is a mobile application designed to help sales professionals master the craft of selling through:

Objection handling practice scenarios
AI-powered sales coaching (the "Chiron" feature)
Goal setting and progress tracking
Gamification features including experience points (XP), levels, streaks, and achievement badges
Motivational content and push notifications
Performance analytics and insights

The App is intended for educational and professional development purposes only.

3. Eligibility

You must be at least 13 years old (or 16 years old in the European Economic Area) to use this App. By using the App, you represent and warrant that you meet the minimum age requirement and have the legal capacity to enter into this Agreement.

4. User Accounts and Data

4.1 No Account Required

SellCraft does not require account registration. Your data is stored locally on your device.

4.2 User Responsibility

You are solely responsible for maintaining the security of your device, all activity that occurs on your device related to the App, backing up your device if you wish to preserve your App data, and any content you input into the App.

4.3 Data Loss

We are not responsible for any loss of data resulting from device malfunction, loss, theft, App uninstallation, or any other cause.

5. Subscriptions and Payments

5.1 Free and Premium Tiers

The App offers a Free Tier with core features and limited AI coaching messages per day, and a Premium Tier with unlimited AI coaching, all objection scenarios, advanced analytics, and additional features.

5.2 Subscription Terms

            Payment will be charged to your Apple ID or Google Play account at confirmation of purchase
Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period
You can manage and cancel subscriptions in your App Store or Google Play Store account settings
Any unused portion of a free trial period will be forfeited when you purchase a subscription

        

5.3 Refunds

All purchases are final. Refund requests must be directed to Apple (for iOS) or Google (for Android) in accordance with their respective refund policies. We do not process refunds directly.

5.4 Apple App Store Terms (iOS Users)

The App is licensed, not sold, to you
Apple has no obligation to furnish maintenance or support services
Apple is not responsible for any product warranties
Apple is a third-party beneficiary of these Terms and may enforce them against you

6. AI Coaching Feature (Chiron)

6.1 About Chiron

Chiron is our AI-powered sales coaching assistant, named after the legendary centaur from Greek mythology who trained heroes like Achilles, Hercules, and Jason to achieve greatness. Just as the mythological Chiron was known as the "wisest and justest of all centaurs," our Chiron AI is designed to guide you on your journey to becoming a sales hero.

6.2 Nature of AI-Generated Content

Important: The Chiron AI coaching feature provides automated responses generated by artificial intelligence. You acknowledge that:

AI responses are for educational and informational purposes only
AI responses do not constitute professional advice (legal, financial, medical, or otherwise)
AI responses may contain errors, inaccuracies, or outdated information
You should use your own professional judgment when applying any suggestions

6.3 Acceptable Use of AI Features

When using the Chiron AI coaching feature, you agree NOT to:

Attempt to manipulate the AI to produce harmful, illegal, or inappropriate content
Use the AI for any purpose other than sales training and professional development
Input any illegal, harmful, threatening, or objectionable content
Share AI conversations publicly while misrepresenting them as human-generated professional advice

6.4 No Liability for AI Content

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL LIABILITY FOR ANY HARM, LOSS, OR DAMAGE ARISING FROM YOUR USE OF OR RELIANCE ON AI-GENERATED CONTENT.

7. Intellectual Property Rights

7.1 Our Intellectual Property

The App and all of its contents, features, and functionality are owned by Andromeda Kinship and are protected by United States and international intellectual property laws.

7.2 Limited License

We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for your personal, non-commercial purposes. This license does not include the right to modify, copy, reverse engineer, or redistribute the App.

8. Prohibited Conduct

You agree NOT to:

Use the App for any unlawful purpose
Interfere with or disrupt the App's functionality
Attempt to gain unauthorized access to any portion of the App
Use any automated means (bots, scrapers) to access the App
Transmit any viruses or malicious code
Harass, abuse, or threaten others
Violate the intellectual property rights of others

9. Disclaimer of Warranties

THE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ACCURACY OF CONTENT.

YOUR USE OF THE APP IS AT YOUR OWN RISK.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ANDROMEDA KINSHIP SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, including but not limited to loss of profits, loss of data, loss of business opportunities, or personal injury arising from your use of the App.

OUR TOTAL LIABILITY SHALL NOT EXCEED THE GREATER OF:

The amount you paid for the App or subscription in the twelve (12) months preceding the claim, or
Fifty dollars ($50.00)

11. Indemnification

You agree to indemnify, defend, and hold harmless Andromeda Kinship from any claims, damages, losses, or expenses arising from your use of the App, violation of these Terms, or violation of any third-party rights.

12. Modifications

We reserve the right to modify, suspend, or discontinue the App at any time. We may update these Terms from time to time. Your continued use of the App after changes constitutes acceptance of the new Terms.

13. Termination

You may terminate this Agreement at any time by uninstalling the App. We may terminate your access immediately for breach of these Terms or conduct harmful to our business interests.

14. Dispute Resolution

14.1 Informal Resolution

Before filing a claim, you agree to try to resolve any dispute informally by contacting us at support@andromedakinship.com.

14.2 Binding Arbitration

Any dispute shall be resolved by binding arbitration administered by the American Arbitration Association in Massachusetts. The arbitrator's decision shall be final and binding.

14.3 Class Action Waiver

YOU AGREE THAT ANY DISPUTE RESOLUTION PROCEEDINGS WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT IN A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION.

15. Governing Law

These Terms shall be governed by the laws of the Commonwealth of Massachusetts, United States, without regard to its conflict of law provisions.

16. General Provisions

Entire Agreement: These Terms and our Privacy Policy constitute the entire agreement between you and Andromeda Kinship
Severability: If any provision is found invalid, the remaining provisions continue in effect
Waiver: Our failure to enforce any right does not constitute a waiver
Assignment: You may not assign these Terms without our consent
